Divorce/Dissolution
In Ohio, there are two ways a marriage can be terminated. One is divorce, the other is dissolution. The divorce process is typically longer in duration and is generally more expensive than a dissolution. The ability for the parties to resolve issues is the determining factor as to which way to proceed.
When spouses cannot agree on resolving issues related to the termination of their marriage, the parties would proceed with a divorce action. A formal filing is made in Domestic Relations Court. Disagreements between the parties will be resolved by the court as part of the trial process. Depending on the circumstances, the divorce process may last several months and likely will result in greater expense than a dissolution.
When spouses decide to end their marriage and agree to resolve all their issues, the parties may proceed with a dissolution. Issues that may arise include those related to children, property, and child and/or spousal support. The dissolution process will typically result in the termination of the marriage in a shorter time period with less expense than a divorce.
